Customer Rental Agreement

This Rental Agreement (“Agreement”) is between Cherokee Crate Company LLC, a Georgia limited liability company, 128 Webster Cir., Holly Springs, GA 30115, (470) 851-6059, hello@cherokeecrate.com (“Cherokee Crate”), and the customer identified in the booking (“Customer”).

By completing checkout and checking the acknowledgment box, Customer agrees to be bound by this Agreement. This Agreement is entered into electronically and is enforceable under the Georgia Electronic Records and Signatures Act (O.C.G.A. § 10-12-1 et seq.).

1. Rental Period

The rental period begins on the scheduled delivery date and ends on the scheduled pickup date, both as confirmed in Customer’s booking. The rental is considered complete when all totes and dollies included in the rental have been returned to and confirmed received by Cherokee Crate.

2. Equipment

Cherokee Crate will deliver the equipment package selected at booking (totes with attached lids, and dollies as applicable). Customer is responsible for all equipment from the time of delivery until the time of confirmed pickup. Customer agrees not to use totes or dollies for any purpose other than moving and temporary storage of household goods.

3. Continued Rental Charges

If Customer retains equipment past the scheduled pickup date for any reason — including Customer-requested rescheduling, unavailability, or missed pickup window — continued rental charges will apply at the following daily rates:

Continued rental charges are compensation for ongoing use of Cherokee Crate’s equipment. Charges begin on the first day after the scheduled pickup date and accrue until equipment is confirmed returned.

4. Replacement Fees

Customer is responsible for the full replacement cost of any equipment that is lost, stolen, or returned in a condition that renders it unusable. Replacement costs at the time of this booking:

Cherokee Crate will notify Customer of any replacement fee before charging, subject to the dispute procedure in Section 7.

5. Damage and Contamination

Normal wear consistent with standard moving use is expected and will not result in a charge. Customer will be charged for:

  • Structural damage rendering a tote unusable (cracks, broken hinges, broken lid latches)
  • Water damage or permanent staining from improper use
  • Contamination requiring quarantine or disposal — including but not limited to exposure to pet urine, mold, food infestation, or hazardous materials

Cherokee Crate will not charge for cosmetic scuffs, minor scratches, or dirt removable by standard cleaning.

6. Cancellation and Refunds

  • Cancellation with 24+ hours notice before scheduled delivery: Full refund of the rental fee. Refund will be issued to the original payment method within 5–10 business days.
  • Cancellation within 24 hours of scheduled delivery: No refund. Cherokee Crate has incurred preparation and scheduling costs at this stage.
  • No-show / unable to accept delivery: If Cherokee Crate arrives at the delivery address during the confirmed time window and Customer is unreachable or unable to accept delivery, this is treated as a cancellation within 24 hours and no refund will be issued.

7. Payment Authorization and Post-Rental Charges

By completing checkout, Customer:

  1. Authorizes Cherokee Crate to charge the payment method on file for the full rental amount at the time of booking;
  2. Authorizes Cherokee Crate to charge the payment method on file for any post-rental amounts, including but not limited to: continued rental charges (Section 3), replacement fees (Section 4), and damage or contamination charges (Section 5);
  3. Acknowledges that prior to any post-rental charge, Cherokee Crate will send written notice by email to the address on file, stating the amount, the reason, and a 48-hour window during which Customer may contact Cherokee Crate to dispute the charge;
  4. Acknowledges that if no dispute is raised within 48 hours of that notice, the charge will be applied automatically to the payment method on file. If the 48-hour window ends on a Saturday or Sunday, the charge will be applied on the following Monday.

To dispute a post-rental charge, contact Cherokee Crate at (470) 851-6059 or hello@cherokeecrate.com within the 48-hour window. Disputes are reviewed and resolved by the owner.

8. Limitation of Liability and Indemnification

Customer assumes all risk of injury, property damage, or loss arising from Customer’s use, misuse, overloading, or improper stacking of totes and dollies. Cherokee Crate’s liability to Customer for any claim arising under this Agreement is limited to the amount paid by Customer for the applicable rental.

Customer agrees to defend, indemnify, and hold harmless Cherokee Crate Company LLC, its members, employees, and agents from any claim, loss, damage, or expense (including reasonable attorneys’ fees) arising from: (a) Customer’s use or misuse of rental equipment; (b) Customer’s breach of this Agreement; or (c) personal injury or property damage at Customer’s premises caused by Customer’s handling of rental equipment.

9. Delivery and Pickup

Cherokee Crate will deliver and retrieve equipment during the time window selected at booking:

  • Morning: 8:00 am – 12:00 pm
  • Afternoon: 12:00 pm – 5:00 pm
  • Evening: 5:00 pm – 8:00 pm

Cherokee Crate will notify Customer approximately 30 minutes before arrival. Customer must be present or designate a responsible adult to accept delivery and confirm return. Customer is responsible for ensuring a clear, accessible delivery location at the service address.

10. Condition at Return

Customer agrees to return totes and dollies in a reasonably clean condition — free of loose debris, food waste, and liquids. Cherokee Crate does not require deep cleaning; removing packing materials and ensuring totes are empty and lids are closed is sufficient.

11. Prohibited Use

Customer may not use totes to store, transport, or contain: hazardous chemicals, flammable materials, biological waste, firearms, or any item the transportation or storage of which is prohibited by applicable law.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Georgia. Any dispute arising out of this Agreement that cannot be resolved directly between the parties shall be submitted to the Magistrate Court of Cherokee County, Georgia (small-claims division). Both parties waive any right to a jury trial for claims within the Magistrate Court’s jurisdictional limits.

13. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the equipment rental and supersedes all prior representations or understandings. No modification is binding unless confirmed in writing by Cherokee Crate.
